Instrument Insurance Policy Details
Your schedule shows the details of the instrument(s) and accessories
covered by your insurance, together with the sum(s) insured and any
Special Clauses and/or terms that may apply.

Please read this page and the schedule carefully to make sure that you have
the cover you need. If you think we have made a mistake or the cover does not
meet your needs you should contact us as soon as possible.

Making Changes to your Cover
Should you need to make a change to your cover, please contact us, we will arrange
for a new schedule to be sent to you.

Making a Claim
Should you need to make a claim, please contact us. Before you do so, please refer to the claims conditions below as it is essential that you comply with them.

As a service to our clients it is usually possible for us to settle any repair/replacement invoices direct with the retailer thus avoiding the need for you to settle the invoice yourself.

Introduction
British Reserve Insurance Company Limited will indemnify or otherwise compensate the insured named in the schedule in accordance with and subject to the terms and conditions of this Policy during the period of insurance.

The proposal made to British Reserve Insurance Company Limited by or on behalf of the insured whether in writing or otherwise shall be the basis of the contract.

The meaning of words and phrases

Period of |insurance
The period specified in the schedule for which you have paid the premium and any subsequent period for which you shall have paid and we have agreed to accept payment of the premium. Your Policy ends at the last day of each period of insurance.

Schedule
A printed document forming part of your Policy showing details of the instrument(s) you have chosen to insure and any Special Clauses and/or terms which may apply to your Policy.

Sum Insured
The most we will pay for each item insured, as shown in your schedule against that item.

Terms, Conditions
The terms and/ or conditions which regulate and qualify the insurance cover provided by your Policy.

They place certain obligations upon you with which you must comply or must fulfil before you are able to make a claim.

Total Loss or Destruction
The sum insured at the time of the loss or damage.

Unspecified Musical Accessories
Accessories shall mean cases, bows, mouthpieces, reeds, mutes or other items used to play or tune the instrument(s) insured under this Policy but excluding items with an individual value of less than £10 or more than £250.

You, your yourself, the Insured
The insured named in the schedule.

What is covered
Your Policy covers Accidental loss of, theft of, or damage to:
   1 the property described in the schedule and
   2 unspecified musical accessories subject to a total of £500 any one less.

Happening anywhere in the world unless the letter 'P' appears next to the item number of such property in the schedule in which case Special Clause No.1 on page 7 of this Policy shall apply.

Policy cover extensions

1 If during the period of insurance you acquire or become responsible for additional musical instruments and which are not otherwise insured, this Policy shall extend to include such musical instruments but not in respect of any appreciation in value and subject to:
  a. You notifying us within 14 days of acquiring or becoming responsible for the instruments
  b. The instruments being added to the schedule and you agreeing to pay any additional premium
  c. Our liability being limited to a maximum of £1,000 any one musical instrument
  d. Our total liability under this extension being limited to £2,500 during any one period of insurance.

2 We will pay for the reasonable and necessary costs of hiring alternative instruments in the event of you making a valid claim under this insurance subject to:
  a. A limit of 10% of the sum insured for the item(s) the subject of the claim and
  b. A limit of £1,000 in total for any one claim.

What is not covered

1 Breakage of strings, reeds and/or drumheads.

2 Loss or damage arising from
  a. Wear and tear, deterioration or any gradually operating cause
  b. Inherent or latent defect
  c. Wet or dry rot, mould, mildew, fungus, rust or corrosion
  d. Insects, vermin or woodworm
  e. Faulty design or workmanship or the use of faulty or unsuitable materials
  f. Any commercial process of cleaning, dyeing, maintenance, repairing, restoration or servicing
  g. Any form of transit by air unless the property insured is securely packed in a suitable protective musical instrument case, or has been packed by a professional transit or removal company
   h. Any form of postal or similar transit unless the property insured is securely packed in a suitable protective musical instrument case or other suitable protective container.

3 Loss or damage caused by
  a. Climactic or atmospheric conditions, changes in air pressure or extremes of temperature
  b. Effects of sunlight, fading, changes in colour, texture of finish
  c. Dampness, dryness, shrinkage or contamination.

4 Loss or damage arising from electronic, electrical or mechanical breakdown failure or derangement.

5 Theft by any person or persons to whom any property described in the schedule is entrusted.

6 Loss or damage to any property described in the schedule whilst left in an unattended vehicle unless the letter "V" appears next to the item number of such property in the schedule in which case Special Clause No. 2 on this Policy shall apply.

7 Any loss or damage caused by the failure of any electrical or computer equipment, software, micro-controller, microchip, accessories or associated equipment, to correctly recognise and process any calendar date or time.

8 Loss or damage by confiscation or detention or nationalisation or requisition by Customs or other officials or legal authorities.

9 Loss or damage happening in connection with riot, civil commotion, earthquake or volcanic eruption occurring outside of Great Britain, Northern Ireland, the Isle of Man and the Channel Islands.

10 Loss or damage arising from
   a. Ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel
   b. The radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or any nuclear components of such assembly
  c. Pressure waves caused by aircraft and other aerial devices.

11 Loss or damage directly or indirectly occasioned by or happening through war, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection or military or usurped power.

Special Clauses
The following special clauses only apply to items in the schedule where the Clause Code Letter is set against the item number.

Special Clause 1: Clause Code Letter P

The property described by this item is only insured whilst contained within your premises, the address of which is stated in the schedule.

Special Clause 2: Clause Code Letter V

Exclusion number 6 on page 6 of this Policy shall not apply to the property described by this item provided that whilst left in an unattended vehicle (other than soft topped or convertible vehicles) you had hidden it from view in the vehicle (for example, in a locked glove compartment or boot), locked the vehicle, with all windows and sunroofs closed, and used all available security systems.

How we will settle your claim

1 In the event or partial damage we will pay for the full cost of repairs and for any depreciation in value arising directly from the damage (but not exceeding in total the sum insured for the item) Provided
  a. Such repairs are carried out without delay and
  b. That the sum insured for the damaged item is adequate to replace that item.

2 In the event of total loss or destruction we will pay the cost of replacing that item with no deduction for wear or tear or depreciation (but not exceeding the sum insured for the item)
Provided
  a. Such replacement is carried out without delay and
  b. That the sum insured for the lost or damaged item is adequate to replace that item.

3 By "replace that item" we mean
  a. For property which can be replaced with a new model identical to the insured item or with equivalent quality and features: the catalogue price at the start of the current period of insurance
  b. For other property: the market value at the start of the current period of insurance.

4 We may at our option indemnify you by cash payment, repair, replacement or reinstatement buy our liability in respect of any item is limited to the sum insured for that item.

5 If you elect not to replace property which has been totally lost or destroyed, the amount payable will be the market value limited to the sum insured for that item.

Special Conditions

1 Premium
The premium or installment must be paid on demand.

2 Precautions
You must keep the insured property in a good state of repair and take all reasonable precautions to prevent accidents, theft, loss or damage.

3 Claims - Action by The Insured
As soon as reasonably possible, you must:
  a. Notify us of any occurrence which may result in a claim and provide any further details which we may require.
  b. Notify the Police:
     i. Of any loss or damage by theft, attempted theft or malicious damage
     ii. If the property is lost outside your normal place of residence.
You must not make any admission of liability without our consent and we are entitled to take over and conduct in your name any negotiations or legal action in connection with a claim under this Policy.
You must provide evidence of value and ownership of legal responsibility if requested by us to enable us to settle your claim.

4 Claims - Our Rights
We are entitled at our own expense to take proceedings in your name to recover any payment made under this Policy, when we consider that there are rights of recover against other parties and you must assist us when reasonably required to do so.

5 Other insurances
If at the time of any loss or damage there is any other insurance covering the insured property we will only pay our rateable proportion of the loss.

6 Passing of interest
When a claim is settled for a total loss the property shall belong to us.

7 Free Reinstatement of the sum insured after a claim
Following a claim other than a total loss the sum insured will automatically be reinstated without charge until the end of the current period of insurance
Provided
that if we make a payment for depreciation in value the sum insured will automatically be reduced to the depreciated figure agreed between you and us. No premium will be refunded in such circumstances.

8 Transfer of interest
We will not be bound by any passing of your interest in this insurance otherwise than by death or operation of law unless and until we agree to accept such transfer of interest by the issue of a revised schedule.

9 Cancellation
We may cancel this insurance by giving 30 days notice in writing to you at your address stated in the schedule, in which event a proportionate refund of premium will be made.

10 Fraud
All benefit under this Policy is forfeited if a fraudulent claim is made.

11 Arbitration
If we accept that there is a claim under this Policy but there is disagreement in respect or the amount to paid, the disagreement will be referred to an arbitrator appointed in accordance with the current statutory provisions. In these circumstances the arbitrator's award must be made before there is any right of action against us.

12 Jurisdiction
This Policy is governed by English law unless you ask for another law and we agree to this before the start of this insurance.

We will confirm to you receipt of your complaint within five working days and do our best to resolve the problem within four weeks. If we cannot we will let you know when an answer may be expected.

If we have not sorted out the situation within eight weeks we will provide you with information about the Financial Ombudsman Service.

The Financial Services Compensation Scheme may provide compensation if we are unable to meet our liabilities under this insurance. Full details are available upon request. This does not affect your legal rights as a consumer.

Data Protection
The details you supply will be stored and used by the British Reserve Insurance Company Limited and other members of the Allianz group to administer your insurance cover. These details will not be kept for longer than is necessary. You are entitled to a copy of all the information we hold about you, for which we may charge you £10. We may pass your name and address to in or associated with the Allianz group so that you may receive details on the full range of services and products they offer. Occasionally we may also pass your name and address to other selected businesses whose products and services we believe may interest you. Notice to customers
You are advised that any telephone calls made to our Administration and Claims Handling Units may be recorded. These recordings may be used to monitor the accuracy of information provided by the customers and our own staff. They may also be used to allow additional training to be provided to our staff or to prove that our procedures comply with legal requirements.
